HEALTHIER MALAYSIA PLEDGE CAMPAIGN TERMS & CONDITIONS


This Healthier Malaysia Pledge Campaign (“Campaign”) is organised by BFM Media Sdn. Bhd. (“BFM Media”, “Organiser”, or “we”) in partnership with Prudential Assurance Malaysia Berhad (“PAMB”) and Pulse Ecosystems Pte. Ltd. (“PEL”) (collectively, “Partners”) along with brand sponsors namely (i) La Juiceria, (ii) Eats, Shoots & Roots, (iii) Babel Fit, and (iv) Prudential BSN Takaful Berhad (“PruBSN”) (collectively, “Sponsors”). By participating in this Campaign, you (“you”, “your”, or “participant”) agree that you have read, understood and agreed to be bound by the Terms and Conditions of this Campaign and by any change or modification that we may make to this Campaign from time to time by updating these Terms and Conditions with prior notice, in which such notice will be given by BFM Media. By participating in this Campaign, you also agree to be bound by BFM Media and PAMB’s Privacy Policy accessible at https://www.bfm.my/privacy-policy and https://www.prudential.com.my/en/privacy-policy/ respectively. If you do not agree with the Organiser and PAMB’s Privacy Policy and the Terms and Conditions of this Campaign, you will not be able to participate in this Campaign.


I. Campaign period

This Campaign will be held from 1 September 2021 till 14 November 2021, both dates inclusive.


II. Eligibility

  1. This Campaign is open to all Malaysians, aged 18 years and above, currently residing in Malaysia who are not the employees, officers, directors or immediate family members of an employee of the Organiser (“Eligible Participants”);

  2. No purchase or payment is required to participate in this Campaign.


III. Healthier Malaysia Pledge Campaign Mechanics

  1. The Eligible Participants must complete the form at https://www.bfm.my/healthiermalaysia (“Form”) and submit the Form within the Campaign Period in order to be entitled to the Campaign Rewards as tabulated below. Forms received after the Campaign Period will be disqualified.

  2. The Eligible Participants may submit multiple Forms in each Campaign Category, but are only eligible to participate ONE (1) time per Campaign Category.

  1. The Eligible Participants will be entitled to redeem the Campaign Rewards in each Campaign Category ONCE only, irrespective of the number of Forms submitted in each Campaign Category.

  2. The Campaign Rewards together with the instructions to redeem will be sent to the Eligible Participants via Eligible Participants’ email address as stated in the Form.

  3. The usage of each Campaign Reward is subject to the terms and conditions of the respective Sponsors.

  4. The Campaign Rewards are not transferable, not exchangeable and not redeemable for cash, credit or in kind.

 

IV. Disclaimers:

  1. By entering this Campaign, each Eligible Participant agrees that BFM Media, its Partners and Sponsors, its respective employees, officers, directors, and affiliates shall not be liable or responsible for damages, losses, injuries, rights, claims or actions of any kind in connection with this Campaign, or resulting from acceptance, possession, use/misuse of the Campaign Rewards, or participation in this Campaign, including without limitation, personal injury, death, property damage and claims based on publicity rights, defamation or invasion of privacy. Each Eligible Participant further agrees that BFM Media will not be responsible or liable for any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, duplicated or otherwise not in compliance with these Terms and Conditions.

  2. BFM Media is not and will not be responsible or liable for any injury or damage to the Eligible Participants' or to any other person's computer relating to or resulting from entering or downloading materials in connection with this Campaign. BFM Media is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission due to technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, communications line failure, server failure, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications caused by the Eligible Participants or by any of the equipment or programming associated with or utilized in this Campaign or traffic congestion on the Internet or at any website, or by any human error which may occur in the processing of the entries in this Campaign, or any combination thereof.

  3. The Partners and Sponsors shall not be held liable to all decisions and actions (including omissions) made by the Organiser.

 

V. General Terms and Conditions:

  1. The Organiser reserves the right to change the qualifying/selection criteria and allocation of the Campaign Rewards from time to time at BFM Media’s absolute discretion.

  1. The Organiser reserves the right at any time to verify the eligibility of any of the Eligible Participants and to disqualify any Eligible Participants who do not meet the above eligibility criteria.

  1. The Organiser also reserves the right to amend these Terms and Conditions, and to suspend, terminate, delay or vary this Campaign with prior notice to the Eligible Participants.

  1. The mode of notification (if any) of the amendment, suspension, termination, delay or variation shall be at BFM Media’s sole discretion, including but not limited to displaying the same in any of BFM Media's website or social media sites.

  1. By participating in this Campaign, the Eligible Participants agree to be contacted by BFM Media’s Partners and Sponsors for the Campaign Rewards fulfilment or administration of this Campaign (if any) and further agree to disclose their personal details (including but not limited to name, NRIC number, phone numbers and email address) to the Partners and Sponsors.

  1. The Eligible Participants are solely responsible for maintaining the accuracy of their information in the Form at all times. The Organiser may request further information from the Eligible Participants to determine the authenticity of any information provided, including whether it is fraudulent or exaggerated.

  1. The Organiser shall have the absolute discretion to decide in respect of all matters and disputes concerning this Campaign in accordance with treating you and other Eligible Participants fairly, including substituting the campaign Rewards with other form of gifts/rewards of equivalent value.

  1. The Organiser reserves the right to publish and display the names, photographs, audio and visual recordings of the Eligible Participants, in any mass media or marketing materials for advertising and publicity purposes without payment or compensation.

  1. The Organiser’s failure to enforce any of these Terms and Conditions shall not constitute a waiver of that provision.

  1. If any of these terms and conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such terms and conditions shall not affect the other provisions and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

  1. This Campaign, these Terms and Conditions and accompanying details and/or guidelines (if any) as may be issued and specified by the Organiser, and all disputes and differences arising therefrom, shall be governed by and construed in accordance with the laws of Malaysia. The Eligible Participants agree that all disputes shall be resolved amicably, failing which the courts of Malaysia shall have exclusive jurisdiction to settle any dispute.

  1. Failure to follow these Terms and Conditions, as may be amended, will result in immediate disqualification and loss of Campaign Rewards.

  2. In the event of any inconsistencies or discrepancies between the Terms and Conditions of this Campaign and the contents of any marketing and/or promotional materials relating to this Campaign, these Terms and Conditions of this Campaign shall prevail.
